In Petrone v. Fernandez , the Appellate Division, Second Department , explicitly acknowledged a split between upstate and downstate courts by allowing a common law negligence claim against a dog owner even when the dog had never displayed any vicious propensities. Just last week, in Rigley v. Utter, the Appellate Division, Third Department, reiterated their vicious propensity requirement by reversing a judgment where the plaintiff’s injuries were not attributable to the dog’s previously displayed vicious propensities or habit of interfering with traffic.
