NYS Legislature Attempts To Alter Medical Malpractice Statute Of Limitations
Wednesday, March 4th, 2009The New York State Legislature is currently considering a bill (A04627 / S1729) to amend the statute of limitations in medical malpractice actions. Under the proposed bill, the accrual of a medical, dental or podiatric malpractice case would not occur until one “knows or reasonably should have known of the alleged negligent act or omission and knows or reasonably should have known that such negligent act or omission has caused an injury.” A summary of the proposed bill can be found here.
